Creditor Rights In And Out Of Bankruptcy

Creditors have various rights in the bankruptcy process and in non-bankruptcy situations. Advocating For Creditors

We advocate for creditors in a variety of bankruptcy-related matters and in non-bankruptcy situations, including matters that involve:

  • Foreclosure: This occurs when a homeowner fails to pay their mortgage and the lender repossesses the home. Following foreclosure, the lender has the right to sell the property.
  • Loan documentation: Any documents that a lender requests from a potential borrower before issuing a loan are referred to as loan documentation. Some of the most common examples include bank statements, proof of income, W-2s and credit reports.
  • Liens: A creditor can make a legal claim, called a lien, against the real estate property or other assets of a borrower as a form of collateral. For instance, if a borrower does not make their mortgage payments, the lender can execute its lien on the home.
  • Loan workouts: This is an arrangement between a creditor and a debtor that allows a debtor to avoid a default. A loan workout could involve lower monthly payments, an extended payment schedule or even the loan’s termination.
